Used Drone Regulations: FAA Part 107 and Remote ID for Second-Hand Drones

The Short Version

The FAA does not track drone ownership. There is no title, no registration transfer, and no paperwork you and the seller sign together. When you buy a used drone, the rules that apply to you as the new owner are the same rules that would apply if you had bought it new. The only thing that changes hands is the hardware.

That is good news and bad news. Good, because nothing about a used drone is legally contaminated by the previous owner. Bad, because it means everything is on you to get right, and used aircraft have a few specific traps.

Registration: Yours, Not the Seller's

Registration in the FAA's DroneZone system belongs to the operator, not the aircraft. The seller's registration number does not transfer with the drone, and a registration that is still active in the seller's name means nothing to you.

• If you fly recreationally: you register yourself once, pay $5, and that one registration covers every drone you fly for fun under the recreational exception. You also need your TRUST certificate, which is free and takes about 30 minutes online.
• If you fly commercially under Part 107: you register each aircraft individually at $5 per drone, valid for three years. If you bought a drone that was previously registered to someone else's Part 107 certificate, you register it fresh under your own name with the same serial number.

One caution: the serial number is the identity of the aircraft for registration purposes. Make sure the serial number on the airframe matches what the seller showed you, because if you register a serial number that has been reported lost or stolen, you will be the one fielding questions.

Remote ID: The Rule That Catches Used Buyers

Since March 2024, most drones flown in the US must broadcast Remote ID, either built into the aircraft or from an attachable module, unless you fly inside a designated FRIA area. This is the single most common compliance gap on the used market, because older models predate the requirement.

Before you buy, ask two questions: does this specific model have built-in Remote ID, and does the seller have proof it broadcasts? Test it if you can meet in person, or ask for a screen recording from the Remote ID viewer in the FAA's app. A used drone that cannot broadcast Remote ID is only flyable inside a FRIA, which for most buyers makes it a very expensive paperweight.

When you register, the Remote ID serial number goes on your registration. If the drone has a built-in module, the serial is the airframe serial. If you add a module later, you register the module's serial and attach it to the aircraft. Both paths are fine, just do not fly before the paperwork matches the hardware.

The DJI Account Problem Nobody Mentions

FAA compliance and manufacturer account binding are two different systems that trip over each other constantly. A Used Drone Is Still a Working Drone

None of this is complicated, it just needs to be done in order: verify the aircraft, confirm Remote ID, register it to yourself, and make sure the account binding is clean.
